Course Syllabus

Abstract

COURSE DESCRIPTION Course “States In International Litigation And Arbitration” is dedicated to the procedural institutes of international dispute resolution, involving states. The course covers litigation in international courts and tribunals (incl. ECHR and ICJ), international investment and commercial arbitration (both institutional and ad hoc), as well as particular aspects of litigation in foreign state courts. Special emphasis is made on the contemporary case law and jurisprudence. The course is conducted in English. PREREQUISITES The course is aimed at students of 1st year of master program or above. Basic knowledge of international law, constitutional law and civil procedure, advanced level of oral and written legal English are required. ABSTRACT 3 ECTS. 16 contact hours The course is build-up as a training, combination of individual and collective exercises, master-classes, development of theoretical and practical skills. The course will be useful for foreign and Russian students seeking to deepen their knowledge on international dispute resolution as well as on legal background on international relations and policy in general.

Learning Objectives

  • Main purpose of the course is to make students able to deal with the typical cases resolved with the states parties in international litigation and arbitration worldwide, make research, prepare and represent legal argumentation. As the result of the course students will obtain knowledge on legal mechanism of international dispute resolution in national, comparative and transnational aspects, recent developments in the sphere, understand the role of the states in international dispute resolution, get practical legal skills, as well as critical view on the existing approaches with regard to the state participation in the international dispute resolution. Most of the similar courses are usually focused mainly on the applicant side interests and applicable law issues, and sometimes underestimate the bipartite procedural nature of the dispute resolution mechanisms, the issues of equality, due process, independence, proper evidence and other important procedural aspects of international justice. This course is based on the more balanced approach. This purpose presupposes necessity of several steps necessary for development of the abovementioned competences. They consist in gaining knowledge on theory of international litigation and arbitration, studying cases and analyzing the peculiarities of the procedure in main international arbitration institutions and tribunals.

  • Students must gain knowledge on Litigation and arbitration as a dispute settlement mechanism, regulatory framework of litigation and arbitration internationally, forms and essential characteristics of international dispute resolution with participation of the states, cooperation between international arbitration and litigation;
  • Students must gain knowledge on Applicable procedures in international disputes, selection and appointment of arbitrators and judges, taking of evidence, state parties’ immunities, nature of awards as well as their recognition and enforcement against states;
  • Skills and abilities: ─ Use specific terms and sources of international dispute resolution; ─ Practical abilities of research, analysis of cases and commentaries; ─ Skills to analyze and solve cases, building up of the legal position and composition of procedural documents; ─ Oral skills and rhetoric; ─ Preparation for participation in real procedures, representing states;
  • Students should gain the following competences: - Ability to work with information (search, evaluate, use information, necessary for fulfilment of scientific and professional tasks, from various sources, including application of the systematic approach); - Ability to work in international legal environment, use international law in day-to-day legal activity;

  • International Dispute Resolution System: Core Problems
    1. History, Legal Framework and General Overview. 2. Recent Developments and Further Reforms (UNCITRAL and HCCH Efforts, Council of Europe’ Approaches, etc.). 3. Legal Career in Representing States in International Litigation and Arbitration.
  • States in International Litigation
    1. Overview of the Major Tribunals Practice (including ECHR and ICJ). 2. State Immunities, Justiciability and Sovereign Power Concepts in International Litigation. 3. Judges’ Activism, Precedents and International Law Interpretation by International Tribunals. 4. Enforcement of Awards against States.
  • States in International Arbitration
    Arbitrability of Disputes against States. State and Its Affiliated Entities in Arbitration. Human Rights in Arbitration. Investment Arbitration. Commercial Arbitration with States.
  • Case Study
    Evidence and Burden of Proof Oral Skills and Legal Argumentation. Drafting of the Award.

    Экзамен проводится в устной форме. Экзамен проводится на платформе zoom. К экзамену необходимо подключиться за 2 минуты до начала. Для участия в экзамене студент обязан: включить камеру и микрофон. Во время экзамена студентам разрешено: пользоваться своими записями и учебными пособиями. Кратковременным нарушением связи во время экзамена считается отключение не более чем на 30 секунд. Долговременным нарушением связи во время экзамена считается отключение более чем на 30 секунд. При долговременном нарушении связи студент не может продолжить участие в экзамене. Процедура пересдачи проводится в устной форме в виде собеседования на основе пройденного материала .
