European Court of Justice Policy Related to Weaker Party Protection in Cross-Border Jurisdictional Matters

The present dissertation is dedicated to the study of a common policy on weaker party protection in cross-border consumer, labor and insurance contracts created by the European Court of Justice (hereinafter – the ECJ). By analyzing case-law made by the ECJ, different legal sources and academic literature the author comes to the conclusion that there is no common policy of weaker party protection under European law, in particular, under ECJ case-law (considering case-law as one of the sources of law having major importance). The classic weaker parties are protected under their own different legal regimes from both substantial and procedural points of view.
