Features of Monopolization of Modern Markets

<p>The problem, caused by Patent Assertion Entities (PAEs) activity, become more actual from year by year. Different high-tech companies spend a lot of money from encroachments on the results of their own activity. It often can be higher than their investments in the innovation of their production. Industrial sector companies spent more than a quarter of their innovation budget because of patent trolls activity in 2013. A share of patent litigations caused by patent trolls increased to 60% of all patent lawsuits in 2013.</p><p>The growing discontent by the leaders of technological development contributed an appearance of different legislative projects. All of them were intended to modernize the patent system of United States. The relevance of this work is also due to the fact that first measures passed the U.S. Congress just six months ago, so there were no research works about actual influence of some law measures against PAEs.</p><p>We consider the U.S. patent system, because this problem has reached a large scale there. It is caused by the developed patent system and liberal legislation. Also number of patent registrations in Russian Federations is relatively much smaller than in the USA, so the Russian patent market isn&rsquo;t developed enough. So, a lot of companies from different industries and countries (also Russian) that decide to go global, become a great aim for patent trolls.</p><p>The main aim of our research is to realize economic and statistical analysis of a current defending measure against Patent Assertion Entities. In this investigation we used the patent litigations statistical database in the USA from May 1, 2013 to May 1, 2014, that helped us to estimate structural change in created sample caused by passing of Innovation Act at December 5, 2013. As a result of our analysis we found that this bill have a great influence on patent trolls&rsquo; behavior. So, the chosen direction of patent system changes is correct. But also company size, one of the regression model parameters, did not change during the entire period. So one of the goals of new bill, redistribution mostly claims from small and medium business for large firms, was not achieved. This direction is a great opportunity for further analysis.</p>
