Illegal Induced Abortion

This graduate paper is aimed at criminal law analysis of illegal induced abortion on the basis of the existing criminal law of Russia. The Central question of the study is to determine the degree of preparedness and knowledge of the criminal act. Based on the aim it is possible to allocate the following tasks: a) name the beginning of human life and the criminal law protection of human rights; b) the study of the law governing the legal / illegal induced abortion; c) analysis of criminal carrying out of illegal induced abortion. Based on the position of the legislator, the author has found that the penal protection of a child's life begins even before the child is born. During the analysis it was established that Russian law is the most liberal in this area. According to official statistics, over the past few years, the number of abortion in the country has decreased significantly. As a result of the comparative analysis of Russian legislation regulating abortion, the author has identified a gap in the current legislation. It is a patchwork of acts, in other words, in the presence of normative acts that establish procedure and criteria of abortion, the criminal law is not focused on these provisions, relying only on a single criterion – abortion is not a qualified entity. In the graduate paper was the analysis of the crime of illegal induced abortion. In addition, the research made a comparative analysis of related articles of the penal law: articles 123 of the criminal code and 111 of the criminal code; article 123 of the criminal code and 106 of the criminal code. Based on the foregoing, and based on the identified gaps, the author has offered the variant of article 123 of the criminal code.
