Reasoning and Procedure of Arrest Application as Preventive Punishment

The aim of this paper is to examine the grounds for the application of detention as well as the identification of individual problems of theoretical and practical part of the detention.

The main objectives of the study: 1) Expand the concept of detention and to give it a general characteristic; 2) study the formation and development of Russian legislation on detention; 3) to explore the legal regulation basis for the election of detention; 3) determine the periods of detention

Based on the results of research and analysis, we can conclude: Given the problems that have been identified in the writing of this work is to present some of the articles of the Russian Criminal Procedure Code in a little different way. Namely, consider the use of detention in the collegiate composition of the court, since the peer review would allow to take into account all the grounds in the decision. In addition, when peer review the final word will be for the chairman of the board, which increases the chance of reducing errors.
