Freedom of Contract as a Principle in the Russian Federation: the Constitutional Aspect

The increasing role of state intervention in economic processes makes the freedom of contract and its limitations, as well as the political and legal basis for restrictions on freedom of contract, a highly significant issue. The aim of this work is to establish and disclose the constitutional aspects of the principle of freedom of contract, to define the political and legal grounds for its limitations. The work consists of two chapters. The first chapter is devoted to determining the nature of the principle of freedom of contract, including public law contracts, its place and role in the context of the economic constitution and legal positions of the Constitutional Court on this issue. The second chapter discusses the limits of the principle of freedom of contract, its limitations, in particular to the weaker party protection, as well as the interraction of freedom of contract with other constitutional values.
