Criminal-legal Characteristic of Bribery

Bribe-taking is one of the most common types of crime, the fight against which is a pressing problem for the state and society. Public danger is caused, first of all, the object of the crime, as well as interfacing with other crimes and deformation of the regulatory state and society of public relations The purpose of this work is a comprehensive criminal legal characteristics bribe. To achieve this goal the following objectives: to study the history of development of the Russian legislation, which establishes the responsibility for taking bribes, characterized foreign legislation on the responsibility for taking bribes, analyze objective evidence of bribe-taking, analyze subjective signs of taking a bribe, to analyze the problem of criminal responsibility for accepting a bribe, to develop and justify proposals for the improvement of domestic criminal law. To solve the problems in the main scientific methods of knowledge were used: dialectic, systematic, logical, and arising from the common chastnonauchnogo methods: concrete-historical, comparative legal, logical-legal, structural and functional, technical and legal, and others. The object of research are the public relations about the use of criminal liability for bribery. The results showed that in the application of the receipt of bribes in practice a number of problems. Adding to the text of the Criminal Code, some changes will improve the efficiency of the mechanism of protection of rights and freedoms, as well as the application of Art. 290 of the Criminal Code.
