Proof in Arbitration Process

Abstract The work is devoted to the research of existing provisions proof institute in the arbitration process from the standpoint of further unification of its provisions in the Uniform Code of the Russian Federation of civil proceedings. The aim of the research is to investigate complex scientific and theoretical and practical problems associated with proof Institute in the arbitration process: definition of the content of proof activities, examination of the subject and the limits proof, the analysis of general and specific rules for the allocation of burden of proof, as well as the circumstances, not to be proved. The formulated conclusions and practical recommendations can be taken into consideration in the work on the unification of the Arbitration and the Civil Procedural Code of the Russian Federation and development on their basis a unified Civil Code of the Russian Federation of legal proceedings, as well as in judicial practice.
