The Legal Nature of The Corporate Body's Decisions in Companies

This graduating paper is devoted to the study of the legal nature of the corporate bodies’ decisions. The aim is the attempt to define the legal nature of the corporate bodies’ decision namely the General Meeting’s decisions. To achieve the goal it is necessary to solve several tasks: 1. To define what is meant by the corporate body; 2. To explore the types of the corporate bodies; 3. To identify the most well-known approaches to understanding of the legal nature of the corporate bodies; 4. To identify the most suitable approach in practical terms, as well as in theoretical; 5. To determine the approach developed in the other countries relates to the legal nature of the corporate bodies. 6. To observe the attitude of courts to the legal nature of the corporate bodies decisions; 7. To make a conclusion about the problem on the basis of the analysis of the Russian Civil legislation and amendments. The basic approaches to understanding the legal nature and the Russian civil law have been analysed, moreover, the attitude of the Russian courts has been studied. At the end of the graduating paper the conclusions about the legal nature of the General Meeting have been made and our view were offered concerning the issue.
