Protecting the Rights of Participants of Business Entities in the Event of Corporate Control Loss

The graduate qualification work devoted by research of protecting the rights of participants of business entities in the event of corporate control loss. Author considers the concept of corporate control from legal point of view, determines the main difference of corporate control in limited liability companies and joint stock companies, analyzes the main reasons for the loss of corporate control. Special attention given to measures to prevent loss of corporate control in business entities. In the graduate qualification work author analyzes of the main methods of judicial protection applicable in the event of loss of corporate control. Author considers the general civil protection methods do not fully take into account the specificity of corporate relations. So applying of these methods in practice associated with certain difficulties. Special attention given to such a special measure to protect corporate rights as recovery of corporate control. This means was created by the arbitration court practice, and subsequently transferred to the legislative support height.
