Pledge as a Way of Providing for the Discharge of Obligations

Graduate qualification project is devoted to the research of the pledge as a way of providing for the discharge of obligations. The main purpose of the graduation thesis is to summarize available information about the pledge in order to understand how to improve this institution for the effective interaction between participants of the pledge law. In addition, key objectives of the research proposal are an examination of historical significance of the pledge, studying the concept and legal essence of its, besides, it is necessary to analyze the provisions of § 3 of Chapter 23 of the Civil code and Federal laws related to the stated issue. Moreover, the author of the paper is exploring recent reforms in the sphere of the pledge legal relationships; makes the review of court rulings; considers the gaps and collisions; identifies way of perfection of the pledge. After examining the legal regulation of the pledge and some other features graduate qualification work presents to a number of conclusions. To sum up, the pledge is the most solid way of ensuring the fulfillment of obligations which has a proprietary nature. Furthermore, the author assesses the innovations which have been made in the pledge law. By the overview of judicial practice some inconsistencies are reveals. Thus, the legislator should develop the pledge law by taking into account foreign experience, the opinions of experts in civil law, the practice of reputable lawyers.
