Legal Regime of Particular Real Estate Objects

The research proposal is devoted to the examination of legal regime of particular real estate objects within the framework of Russian law. The aim of this paper is the analysis of the legal nature of non-residential premises, a unified real estate complex and enterprise as an object of civil rights, along with consideration of topical issues related to the implementation of the legal regimes of these things and development the author's own position on some of the more controversial issues. Presented paper establishes the necessity of consideration of the real property exclusively in legal sense, not in physical-technical one; defines the notion of non-residential premises, identified by its legal nature; studied the form, procedure and main terms of making bargains with non-residential premises; it also outlines the conditions of fulfillment of obligations under these transactions; analyzes the norms establishing the legal regime applicable to the new object of civil rights – a unified real estate complex, the peculiarities of the legal regime of this species of property; the estimation of projects of federal statutes which include rules about unified real estate complex.
