Public Nature of the State Corporations in the Russian Federation

This paper is aimed at considering the legal status of the state corporations. The main objectives of the paper are: (a) analysis of the legislation regulating the legal status of the state corporations; (b) analysis of the term "state corporation" and considering of its main characteristics; (c) considering of the foreign experience of the state corporations functioning; (d) description of the historical formation of the state corporations in Russia; (e) identifying of the problematic aspects of the legal regulation of the state corporations. The paper consists of an introduction, two chapters, five paragraphs, a conclusion and a bibliography. Chapter I describes the legal nature and the main characteristics of the state corporations. Chapter II is dedicated to the issues of the state corporations functioning. Based on this research the following conclusions were made: firstly, the state Corporation is one of the form of the government participation in the economy. A feature of the legal status is the dualistic legal nature – the combination of features of the legal entity and functions of the public authorities, the combination of the normative regulation and the individual legal regulation; secondly, a distinction between state corporation as a form of the organizational form of legal entity and as a part of the name of the legal entity, which inherently relates to other organizational forms. The usage of the term "corporation" violates the basic rules of the legal technique. thirdly, the impossibility of applying traditional indicators of efficiency of the functioning of the public corporations in force on a non-commercial nature of their activities. The necessity of the development a set of measures which help to solve the problems related to the lack of criteria (indicators) which would determine the effectiveness of public objectives implementing, and indicate the rationality of using the property transferred to them.
