Dismissal for Redundancy of Employees: Problems of Legal Regulation And Enforcement

The relevant subject of this thesis is devoted to dismissal for redundancy of employees. The purpose of this thesis is to analyze the studies and research of the legal regulation provisions' aspects, pertaining to termination due to downsizing in its current changes and application. The first chapter of the thesis deals with the historical introduction of personnel reduction, stating the periods respectively. Human rights concept in connection to the discharge right and protection against dismissals are discussed. The second chapter describes the dismissal operation as a general principle of the international and national law. The third chapter introduces the abuse of the right to downsize staff , especially the prohibition of the abuse of the right. The jurisprudence issues also take place in the chapter. As a result, this dissertation has investigated the purpose to arrange the provisions on downsizing into different clauses. The author also emphasizes the necessity to outline the abuse of the right by means of the Labour Code of the Russian Federation in order to improve the procedure of enforcement. This thesis contains introduction, three chapters, conclusion and reference list.
