Concept of the Employment Contract, its Parties and Contents

The purpose of this graduate paper is a comprehensive study of the evolution of features of the contract regulating hired labor, identification of its characteristics by analyzing the content of the employment contract, taking into account characteristics for different categories of employees. The main objectives of the paper are: (a) consideration of legislation`s development on labor relations; (b) assessment of views on the nature and concept of the employment contract; (c) study of parties and content of the employment contract; (d) identification of the challenges and tendencies associated with the employment contract. The paper consists of introduction, three chapters, conclusion and bibliography. Chapter I deals with the history of the contract regulating hired labor, the concept and main features of the employment contract. Chapter II is devoted to the content of the employment contract. Chapter III discusses the features of the employment contract with certain categories of workers. On the basis of the analysis the following conclusions were made: firstly, modern concept and content of the employment contract resulted from the continuity of the legal foundations of the contract regulating hired labor; secondly, the legal definition provides all specific features of labor contract; thirdly, the mandatory conditions of the employment contract provide a safeguard against abuse of the employee and the employer; fourthly, additional conditions give the parties an opportunity to respond to the specific aspects of their employment relationship; fifthly, today there are new opportunities to obtain employment under atypical employment contracts; finally, the employment contract is not a "fixed" form, so it is important to update existing legislation in the sphere of labor to the needs of changing society.
