Invalidation of Patent for Invention , Utility Model or Industrial Pattern

The purpose of work consists in comprehensive study of the right regulation of objects of patent law. For achievement of a goal it is necessary to carry out the following tasks: to study history of development of the legislation connected with protection of the rights for the invention, useful model or an industrial sample, to study the legislation, doctrinal provisions and law-enforcement practice connected with the purpose of this work, to allocate definitions of the basic concepts and to provide their characteristic, to designate legal positions on this subject. The methodology consists of the following methods: the dialectic, assuming full, comprehensive and objective studying of the facts, significant for a subject. Following group of methods: the analysis, deduction, synthesis, etc., belong to general scientific and are the tools helping to study legal problems. Also historical, comparative and legal methods (relating to special) which have helped to determine interrelations and consistent patterns were used. Logical and legallistic have also been applied to the analysis of the available scientific material and development of remarks to him. VKR consists of the following parts: Introduction in which basic provisions are designated. Further it consists of chapter 1 in which history and the characteristic of the patent, his appointment reveal. In chapter 2, the bases for recognition of the patent invalid are in detail studied, their classification is given and legal consequences of such decision are described. The problems connected with legislative practice in this area are given in a chapter 3. In the conclusion the results of this work are summed up and the conclusion is drawn. The list of the used standard legal sources and literature is also given.
