Dominant Position on the Market

Dominant position of an economic entity on the market is one of the most developed institutions of competition law not only in Russia but throughout the world. The dominant position is the economic power of the entity and in its large share of the market. This position of the economic entity is legal in the case if it does not abuse its dominant position. The problem of the graduate paper lies in the increasing number of large enterprises holding the dominant position and cases when they often violate of it. This situation requires to restore the balance of economic power of legal entities. The purpose of the graduate paper is to determine the essence of the dominant position and analyze various forms of its abuses. The aims of the work are to explore the essence of dominant position’s nature, to identify criteria for its definition, to explore the definition of abuse of dominant position, to consider its various forms, to determine characteristic features of price, product, contractual and other forms of abuse. The results obtained in the final present the content for all 5 above tasks. In the process of conducting research the following methods were used: system review, analogy, comparison and generalization. Competition law in the light of the consideration of the dominant position of an economic entity on the market protects interests of weaker parties (enterprises-competitors and consumers) from the abusive enterprise in the form of prevention, restriction or eradication of competition. Institute of antitrust law “dominant market position” which was composed from the model of foreign (as well as the whole competition law) has a large number of common features with it. However, the institute of “dominant position” has its own way of development and improvement in accordance with the realities and distinctive features of the Russian economy.
