Constitutionalism of DPRK and South Korea: Challenge and Problems

Nikulin MM Constitutionalism of North Korea and South Korea: Problems and Prospects The purpose of this final qualifying work is to examine the constitutional and legal regulation in the DPRK and the Republic of Korea, on the basis of which to analyze and find out the current state of constitutionalism in the two countries and prospects of its development. We will solve a number of problems, including these goals: to consider and explore and subordinate regulatory legal acts regulating questions of a constitutional nature in North and South Korea; identify patterns in the constitutional and legal development of the North and South Korea. Final qualifying work consists of an introduction, three chapters, nine paragraphs, conclusion and list of references. Based on the analysis the following conclusions: Firstly, North Korea throughout the history of North Korea existed a stable and rigid dictatorship, which began to soften due to changes in global political and economic conditions, resulting in the country were the prerequisites for the full implementation of constitutionalism ideas; Secondly, in South Korea, as well as in the North, initially there was a dictatorial regime, which by the end of 1980 has been eliminated adoption of the Constitution in a new version; Thirdly, with the coming to power in North Korea Kim Jong-un has deteriorated condition of constitutionalism in the country, together with the possibility of the peaceful unification of Korea, however, in the case of the overthrow of the totalitarian regime in North Korea, there are prerequisites for the establishment of the country's full-fledged regime of law and peaceful reunification.
