Legal Regulation of the Contract for Sale of Real Estate Encumbered by Rights of Third Parties

Final graduation work is devoted to relevant topic of legal regulation of the contact for the sale of real estate encumbered by rights of third parties. The subject of the research work is concentrated on the transactions with encumbered accommodation. The work is based on theoretical and practical study of the topic. The theoretical aspect includes evaluation of the main features of legal regulation of the contract for the sale of real estate; it also includes exploration of the legal nature and characteristics of "encumbrance" as a legal institute, which is based on its separation from another one "restriction of rights." Moreover, different classifications of encumbrances of real estate and analysis of specific types of encumbrances of accommodation are presented. The practical aspect includes identification of encumbered property acquisition risks, associated with the contract for the sale of real estate. The research work is based on study of scientific and practical sources, which illustrates the main problems in this area. What is more, recommendations of risks minimization in acquisition of encumbered property are presented. According to the results of the study general conclusions are formulated.
