Legal Regulation of Employment of Judges in the Russian Federation

The purpose of final qualification work is the analysis of work of the judge through science of the labor law and search of scientific proofs that judges are a special subject of the labor law, get under the labor legislation, so, these relations demand legislative registration. Research problems are identification of the possible bases of differentiation of work of judges; consideration of concept of the status of judges taking into account differentiation of employment-legal regulation; consideration of an order of election of the judge to a position; determination of features of emergence of the labor relations with judges; detection of expediency of an execution of an employment agreement with judges; studying material and social providing judges. On the basis of the conducted research the following conclusions are drawn: first of all, the judge is a subject of the labor law and labor legislation regulated their work in that part in which it isn't settled by the Federal Law "About the status of judges in the Russian Federation"; secondly, being a special subject of the labor law, there is need an execution of an employment agreement with judges for specification of their powers; thirdly, there is a set of legislative gaps, especially regarding regulation of the rights and duties of judges Supreme, Arbitration and other courts. A big variety of the general norms with additions contains in the Law "About the Constitutional Court of the Russian Federation". It is necessary to create the uniform standard and legal base governing the labor relations of judges proceeding from their status as subject of the labor law.
