Banker's Commission

This graduate paper is aimed at considering the legal nature of banking commission and legality of their collection. The main objectives of the paper are: a) considering the legal nature of banking commission b) analysis of certain types of banking commission. The paper consists of an introduction, two chapters, eleven paragraphs, conclusion and a bibliography. Chapter I considers the concept of "banking commission", international experience of regulatory of banking commissions. Chapter II considers the different types of banking commission. Based on this research the following conclusions were made: firstly, the Russian legislation does not disclose the concept of "banking commission"; secondly, in foreign practice different approaches to the regulation of banking commission; thirdly, there was a practice to recognize the majority of banking commission illegal, because they are not self service, creates for the borrower any additional benefit; fourthly, we believe that the banking commission should be defined not only as a fee for the bank's services, but also as a charge aimed at reimbursement of expenses of the bank; fifthly, we believe that it is necessary to recognize the legitimate collection of most commissions.
