Mortgage as a Way to Ensure Performance of Obligations in the Russian Federation Civil Law

In this paper the author conducts a comprehensive analysis of mortgage institution in the civil law of the Russian Federation. The main objective of this study is to examine the characteristics and problems of legal regulation of mortgage as a way to ensure performance of obligations. To achieve this goal the author defines the place of pledge in a system of ways to secure performance of obligations, examines the bases for the origin of pledge, reveals the main types of pledge, analyzes the concept, essence and legal regulation of mortgage, studies the mortgage agreement and describes the procedure of foreclosure on property mortgaged under the mortgage agreement. The structure of the study includes introduction, two chapters, each of which consists of three paragraphs, conclusion, bibliography and application.
