The Institution of Appeal in Civil Procedure – Current Situation and Prospects for Development

The work expounds the institution of appeal in Russian civil procedure on the base of analysis of the Civil Procedure Code of the Russian Federation and the practice of its implementation in court decisions. Besides, in order to identify the legal nature of the institution considered in the study the author provides the observation of the historical development of appeal since the XVI century until now. Special attention is also paid to the correlation of complete and incomplete types of appeal in the Russian civil procedure and to the issue that an appellate court has no right to send a case to retrial. Considered in the paper are also prospects for development of the institution of appeal. The author highlights a number of problems of the institution of appeal, which have not been solved by the 2010 reform. The study refers to the Concept of the unified Civil Procedure Code and provides recommendations for changes of current legislation, which are not considered in the Concept and can be used when drafting the unified Civil Procedure Code.
