The Participation of Lawyer/Barrister in Civil Proceeding in Russia and England

The paper is devoted to description, analysis and research of particularities of representation conducted by advocate/barrister in Russia and England. Thus, the primary aim of the paper is research, analysis of certain particularities and comparison of legal regulation of advocacy and advocates’ activity in civil proceeding in Russia and England. The methodological framework used in the paper amounted to general scientific methods (system analysis) as well as some specific scientific methods. Logically, the paper is divided into two parts, each of which describes and analyzes issues specific to certain most general aspects of legal regulation, particularities of representation in civil proceedings in general and the institution of advocacy in particular. The first chapter is devoted to Russia, the second is devoted to England. Each chapter is divided into several paragraphs in which the following issues are described in sequence. The first paragraphs of the chapters describe the concepts, definitions and the main types of procedural representation in civil proceedings in Russia and England. The second paragraphs describe the legal regulation and the current state of advocacy. The third paragraphs describe the features of representation in civil proceedings conducted by an advocate/barrister in each of the described countries, its role, importance, necessity and particularities. Finally the main conclusions made as a result of the conducted research and analysis complete the paper.
