Legal Protection of Artificial Person’s Business Reputation

The paper is an attempt to study the institute of business reputation and the issues of civil-legal protection of artificial person’s business reputation in the Russian Federation. Having analyzed the provisions of the federal and regional legislation, doctrinal sources, the author determines the concept of goodwill, the right to protect any immaterial values, the development of the institute of judicial protection of honor, dignity and business reputation. Nowadays the existence of positive business reputation is a necessary condition for functioning of the organization. That is why it is so important to protect it. When untrue, discrediting business reputation information is spread, the entity may use enforcement measures, established by the legislation and aimed at the restoration of broken values. The most effective way is to turn to courts with claims for protection of honor and dignity or business reputation. For such a short time, a huge number of individuals and organizations turned to courts with claims for protection of honor and dignity or business reputation. This phenomenon showed a long-standing need for such civil legal institution – civil protection of non-material values of individuals and entities – and the long-awaited solution to this problem by the legislator. However, despite the huge judicial practice that has developed over the past two decades, the judges still face many difficulties and problems, not resolved in the legislation, that shows an imperfection of the institute of civil procedure and the urgent need for its further investigation. In present research the author also determines the features of the right of business reputation protection and its appropriate legal regime and analyses the protection procedure.
