The Protection of Property Right and Other Rights in Rem

This final qualification work is devoted to systematic analysis of the mechanism of civil protection of the property right and other rights in rem, and the formation of the unified conceptual approach to this legal institution. The scientific novelty of the study is reflected in the development of theoretical, integrated approach to the problem of the civil-law protection of the property right and other rights in rem, that allows to erect this extensive legal institution into a single simplified system, which can be used by defensive party as a theoretical tool. The volume of the study is sixty three pages, and its structure consists of introduction, two chapters, which unite six paragraphs, conclusion and bibliography. In the introduction were justified the relevance and the scientific novelty of the research, were determined its object, subject, purpose and objectives, as well as was given the general characteristic of methodological, theoretical and normative bases of the study. In the first chapter «The system of the property rights and their protection» the author defines the types of the property rights and their key elements, reveals the general concept of the property right and other rights in rem protection, and also provides a classification and the detailed description of the methods of such protection. In the second chapter «The characteristic of the civil-law methods of the property right and other rights in rem protection» the author examines proprietary, obligation and other ways to protect the property rights. In conclusion of the study the author summarizes the intermediate theses, which were proposed during its conduction, and formulates the final conclusions and suggestions on the problem of the civil-law protection of the property right and other rights in rem.
