Recognition and Enforcement of the Foreign Arbitral Awards on the Territory of the Russian Federation

This master dissertation is aimed at examining the features of the recognition and enforcement of the foreign arbitral awards on the territory of the Russian Federation. The master dissertation consists of an introduction, three chapters, nine paragraphs, a conclusion and a bibliography. Chapter I elaborates the definition, legal nature, legal regulation, types and principles of international commercial arbitration. Chapter II contains the definition, properties, decision procedure of the arbotral award. Section III is on problematic issues of the recognition and enforcement of the foreign arbitral awards on the territory of the Russian Federation. Based on this research the following conclusions were made: firstly, International commercial arbitration is an alternative way to resolve international commercial disputes; secondly, the basis for International commercial arbitration is the arbitration agreement; thirdly, the main aim of the international commercial arbitration is dispute resolution between parties of an international contract, the outcome of which is the making of the arbitral award; fourthly, the arbitral award could be challenged by the interested party who is based on legislation; fifthly, the arbitral award has the property to be enforcement in the territory of a State different from the State in whose territory the award was made; sixthly, one of the grounds for refusal of enforcement of the arbitral award is a potential violation by such award the public policy of the State in which territory asked the recognition and enforcement of an arbitral award; seventhly, at the legislative level of the RF there is no definition of public policy.
