Legal Aspects of Private Deposit Insurance

Relevance of the topic of this thesis "Deposit Insurance: Legal Aspects" is, first of all, that to this day is controversial in science question about the nature of the deposit insurance and its place in the system of Russian law. The researchers identified problem disagree belong whether the mandatory deposit insurance rules to the private or public law. On the one hand, the Federal Law of 23 December 2003 № 177-FZ "On insurance of individual deposits in the Russian Federation" (hereinafter - the Deposit Insurance Law) applies the typical terms of insurance law, which gives reason to conclude that the nature of private law institute deposit insurance. However, other features of this legal institute cast doubt on this. In addition, a number of problems (off-balance sheet accounts opened by credit institutions unscrupulous investors, crushing deposits, etc..) Shows significant gaps in the current legislation, which violates the uniformity of judicial practice. This diploma thesis includes an introduction, three chapters, conclusion and list of references.
