The thesis is devoted to the issues related to the provision of legal protection of trademarks and consideration by arbitration courts of disputes about the unlawful use of trademarks. In the thesis made analysis of the features of forming the subject of proof in this category of disputes and the distribution of the burden of proof, depending by the plaintiff selected method of protecting; were considered the most frequently encountered in these disputes the evidence, order of their presentation, research and evaluation.
