Legal Regulation of Using Trademarks in Domain Names

The paper illustrates the legal regulation of the two institutes: domain name and trademark in the Russian Federation. The main questions of this study are to understand which legal regime of using trademarks in domain names and investigate problems which are appeared in this sphere. For achieving this aim in this study are given definitions, features and types of the trademark and the domain name. The exclusive rights to the trademark are investigated in this work. Moreover, it is defined the legal nature of the domain name. Also it gives the definition of a good faith of trademark owners and owners of the domain name. The agreement about "the lease of the domain name" and the consequences of it for the owner of the trademark are analyzed. It is specially noted that there are different problems which are connected with domain’s disputes that are relevant for further investigation because domain names are regulated as not so clear as trademarks in the Russian Federation and courts apply international and national legal regulation solving domain disputes.
