Legal Regulation of Payments by Bank Cards

During the period of market relations money become the means of payment, it is hard to organize the activity of economic entities without it. The important objective to be solved by the implementation bank cards is to ensure the availability of payment services to various groups of population. Bank card is fast becoming a key instrument in the sphere of banking transactions, displace and replace cash money and check books. The problems of legal regulation by Civil Code of Russian Federation and special acts: the acts regulating the issue of bank cards, effectuation non-cash payments by cards will be investigated in this work. The novelty of the research is derived from the analysis of the legal scientific literature, which suggests that legal qualification of non-cash payments has heterogeneous nature. This study examines the emerging role of bank cards in the context of legal regulation of payments. Much uncertainty still exists in the relationship between a cardholder and emitting bank, particularly the rights, duties and responsibilities of the parties. This indicates the need for a detailed study of the legal regulation of payments with bank cards.
