The paper deals with the European Union's legal policy. Main attention is paid to the Court of Justice as an actor of formation and implementation of policies provided. The authors determined that due to the nature of the institutional system, the Court has the authority of the full-fledged political actor and can participate in any cycle of the political process: agenda setting, policy formulation, policy adoption, policy implementation. Based on the analysis of the cases the authors make a conclusion on the issue of the Court's status and the necessity of decreasing the risks of its growing actorness.
