Protection of Shareholder Rights to Their Shares Lost for Reasons beyond Their Will

This masters dissertation attempts to analyze the current legislative framework regulating relations that arise with respect to company shares. In particular, the work considers in detail the issue of protection of shareholder rights to shares which were lost for reasons beyond their will. Detailed consideration of issues pertaining to the legal notions of a share, rights to shares, the recording of shares and the procedure for transfer of shares allows to identify and qualify the totality of circumstances leading to shareholder loss of rights to their shares for reasons beyond their will, as well as the circle of parties who can engage in legally significant acts leading to such a loss. Ultimately, the generalization of the aforementioned intermediate results allows to outline a list of available legal measures for protection of shareholder rights to shares lost for reasons beyond their will, as well to assess the effectiveness of each such method of rights protection.
