Freedom of the mass media represents the essential part of life-sustaining activity of any democratically advanced society and state where the great importance is placed on the system of rights and liberties of human and citizen, which the state has to obey, protect and guarantee. Thus, the provision of the necessary law conditions for implementation of this traditional function of the mass media is one of the main reasons of establishment in the legislation of democratic states the security of free activity of mass media. In recent times it can be mentioned the active attention to the problem of freedom as a whole, that also connected with the lack of effective legal regulation which often can lead to the violation of legal rights and interests of the citizens. It also should be mentioned about the real threat of formation the persistent trend of mass media usage with the aim of manipulation of public opinion in the private interests of the certain groups. legislation is not allow to effectively prevent and suppress many forms of misuse of mass media freedom without stop of material dispersal, which can cause harm to moral and intellectual development of the individual. Without effective constitutionally acceptable legal limitation of mass information freedom, which is focused on prevention of misuse of this freedom, the activity of mass media has a tendency to deconstructive impact on individual development, society and the state development, representing a threat for democratic development of the state. The complexity of the entire system of constitutional framework for freedom of mass information can be demonstrated in its inconsistency which gives impetus to the development of this system including the activity of constitutional court of the Russian. In modern times the legislative system which regulates the activity of mass media is in the volatile state. Its development depends on set of circumstances and thus can be continued in different ways.
