Problems of Lots Formation for the Procurement of Goods, Works and Services, and Potential Solutions

Lot is an important tool for public procurement, which optimizes the procurement process. Today the question of optimization of the procurement process, of course, is relevant. Forming lots customers helps optimize the cost of procurement and documentation. Currently, legislation does not provide clear definitions of what goods, works or services may be considered functionally and technologically connected. Therefore, problems forming the lot. The lack of a unified approach to the unification of goods, works and services in a single lot can lead to a distortion of competition (contract system). In the course of writing a nonfiction work, in which the two strategies form the lots were allocated was analyzed. Strategies for consolidation (associations) and reduction (crushing) lots. In the scientific literature, positive and negative aspects of strategies have been identified. Analyzing the experience of foreign countries, it has been revealed that the priority objective is to stimulate competition customers. Speaking about the US experience should be noted that prior to the formation of the lot, the customer must carry out market research. According to the survey, the customer decides on the composition of the lot. Speaking about the Russian practice, it should be noted that the rationale for the presence or absence of technological and functional connection varies depending on the specifics of the purchase. It was also revealed that regulatory authorities determine the legitimacy of choosing different associations of goods, works and services in one lot. Heterogeneity decisions on similar issues, affects the functioning of the public procurement system, as participants in the procurement may be at a disadvantage. Therefore there is a need to establish a mechanism contributing to solve the problem. In this paper, it was proposed to justify the composition of the lot by the result of the market analysis.
