Peculiarities of Franchising Legal Regulation in Russia

The use of franchising to business regulation and business is gaining momentum. Commercial concession begins to spread through the network «Internet», as well as new market segments (e.g. private healthcare). However, intense change the current civil legislation, the shortcomings of the legal, as well as the lack of a comprehensive study of regulation of relations of commercial concession, leads to the fact that entrepreneurs, most of them use different ways of regulation of arising relations. In order to solve these problems in the final qualifying work examines the issues concerning the peculiarities of legal regulation of the contract of commercial concession. Special attention is paid to the problem of correlation of the terms «franchising» and «commercial concession», determining the number of significant terms and the term of the contract, as well as about the peculiarities of registration of the contract in Rospatent and its implications, and proposes to amend the existing legislation. Conclusions and suggestions aimed at improving legal regulation of the contract of commercial concession, and also the formation of a complex of knowledge in this field of legal relations.
