Reimbursement of Costs for a Representative in Arbitration Court (adjudicatory) Proceedings

As a part of study of the problem of apportionment of legal costs in the arbitration proceedings, the author, on the basis of an analysis of the existing arbitration procedural legislation, scientific works and court practice, concludes that there are contradictions in the norms regulating the issue of compensation of legal costs, which do not lead to uniformity of court practice. In this regard In the light of this, great importance is attached to the explanations given in the Resolution of the Plenum of the Supreme Court of the Russian Federation of 01.01.2016 No. 1 "On Certain Issues of Application of the Law on Reimbursement of Costs Relating to the Consideration of the Case» which are also considered and justified in the thesis. The author suggests measures to improve the legal regulation in this area by introducing appropriate changes to the Arbitration Procedural Code of the Russian Federation.
