Legal Regulation of Franchise Agreement

Nowadays, franchising is one of the most popular form of doing business. Abroad such form of doing business is realized through the franchise agreement. In the legislation of the Russian Federation there is no definition of a franchising agreement. However, the legislation of our country has a similar agreement – a commercial concession agreement. Many researchers identify these terms, however, whether this is true is going to be considered in this study. In connection with the foregoing, the present work will consider the establishment of a commercial concession agreement and a franchising agreement. The correlation of the concepts of these contracts and the place of the contract of commercial concession in the system of civil law contracts will be analyzed. Also, the legal nature of the contract of commercial concession, its dynamics, in particular, the grounds and procedure for changing and terminating the contract and the responsibilities of the parties under this agreement will be examined. In conclusion, the generalized results of the study will be presented and the necessary conclusions drawn.
