Abuse of Power in a Commercial Organization

The concept of the abuse of power is a very popular and important category both in the Russian Criminal Code and in the Russian criminal law enforcement. Notwithstanding of this fact, there are a lot of problems related with the need to find the right comprehension of the characteristics of the concept of the abuse of power in a commercial organization. These problems have been discussed in recent years but the results of the existing studies and theories are very contradictory and controversial. Besides, in this paper we carry out the comparative analysis of these theories and postulate a number of theoretical hypotheses related to the doctrinal concept and characteristics of the abuse of power in a commercial organization. Moreover, we offer some new approaches in understanding of the abuse of power’s elements (characteristics). Particular attention is paid to determining the criminal legal significance of the beneficiary ties of commercial organizations
