In this paper, a meaningful analysis of the criminal liability for drug smuggling in the Russian Federation was conducted under art. 229.1 of the Criminal Code of Russian Federation. The relevance of this topic is due to a number of circumstances, such as: recent changes in legislation on this type of crime - within the framework of an independent art. 229.1 of the Criminal Code of the Russian Federation, the number of registered crimes for this type of smuggling is much higher than all other types of contraband, drug trafficking is a crime with a significant public danger (Article 229.1 of the Criminal Code includes two qualifying groups that are classified as particularly serious crimes (part 3 and h. 4), there are difficulties in the qualification of certain signs of the composition of drug smuggling, the work of the legislator on this issue continues to this day. In this paper we considered the historical aspect of the legislative regulation of drug smuggling, analyzed the norms of the current legislation on drug smuggling, described legislation of foreign countries that criminalize drug smuggling, analyzed objective and subjective signs of the crimes set out in art. 229.1 of the Criminal Code of the Russian Federation, the problems of the qualification of drug smuggling were examined and highlighted, and proposals were made to improve legislation related to drug smuggling. Thus, all the tasks were fulfilled, and the main goal which is comprehensive study of criminal liability for drug smuggling was achieved.
