Legal Regime of Folklore Expressions

Nowadays, at time of fast economic development and at the global and information environment, when everyone has access to everything, there are a lot of problems appearing, related to interests of native people and to the protection of their culture, traditions, art.

The traditional art and the folklore have wide and specific, unique for every native society, from where they come. That’s why they have economic value – folklore expressions are a base for production of new goods, based on the traditional knowledge. Whit the arising exploitation of traditional culture and traditional knowledge for commercial aims, the rights of the native groups, who are their creators and keepers, are valuated. The valuation of their rights is happening because of the character of the traditional knowledge and the folklore and because of their non-define legal regime.

The work is based on analysis of the character and the nature of the folkloric expressions and the way of using the intellectual property system regime. In the paperwork, there is analysis of already existed object of Intellectual property and their legal regime and the possibility of usage of existing legal regimes to protect the folklore expressions.

New forms of folklore expressions (folklore in the virtual reality) are also analyzed in the paperwork. Analysis of their characteristics and the options of their protection by the Intellectual property system is made.
