Liability for Illegal Formation of a Legal Entity in Russian Criminal Law

The constant struggle of the state aimed at eliminating the criminal element from economic relations has resulted in adoption of Article 173.1 of the Criminal Code of the Russian Federation which sets out liability for illegal formation of a legal entity and of Article 173.2 of the Criminal Code of the Russian Federation which sets out liability for illegal use of documents for the formation of legal entities. At the moment, the question of what an illegal education is not well-studied, and therefore quite relevant. The purpose of this paper is to solve legal and practical problems in the sphere of illegal formation of legal entities, as well as to develop recommendations for improving the current legislation. To fulfill the given purpose following goals must be met: a) to identify the prerequisites, patterns, trends in the development of legislation in the field of criminal liability for the illegal formation of legal entities; b) the definite socio-legal prerequisites for the criminalization of the norms in question; c) to give the criminal description of the elements of crimes under Article 173.1 of the Criminal Code of the Russian Federation and Article 173.2 of the Criminal Code of the Russian Federation; d) to conduct a legal analysis of other crimes in the sphere of illegal formation of legal entities; e) to develop recommendations for investigating violations of the law in the sphere of creation of legal entities; f) to develop the main trends for the improvement of legislation in sphere of formation of legal entities. This paper consists of the introduction, two main sections, divided into paragraphs, conclusion and reference list.
