Relevant Issues of Public Purchases under Federal Law 223-FZ “On Purchasing Goods and Material / Immaterial Services by Particular Types of Legal Entities”

The project proposal is an attempt to examine the problematic issues of public purchases, made by certain types of legal entities. Investigating the basics, which extend to the buying activities of state corporations, the author single out gaps in law (law collisions), which preclude a more efficient use of budget funds. At the moment, the concept of public purchases by entities with public participation is not contained in any federal law. In this regard, the author determines the essential features of such purchases, so they make it possible to formulate the original terminology. The principles of purchases by state corporations, established in Federal Law No. 223-FZ, are also considered, the reasons why these principles are not fully observed are revealed. Finally, the practical manifestation of ineffective parts of Federal Law No. 223-FZ is considered.
