The Paid Medical Services Agreement and Legal Remedies for Violation Medical Confidentiality

The present investigation touches upon a wide range of problems connected with the paid medical services agreement and medical confidentiality. It describes essential characteristics of the contract, emphasises some peculiarities of its elements. The study analyses specialities of contracting parties. The singularity of the scope of the contract is emphasized. This way it serves like the main criteria to differ the paid medical services agreement and the independent-work contract. The priority aspects of the contract tenor (rights and obligations of the parties) are considered. The project also identifies the legal nature of medical confidentiality from three aspects: as patients’ right and corresponding doctors’ obligation, as the necessary ground of the doctor-patient relationship and, finally, as a term of the paid medical services agreement. The results anticipated advance the understanding of the scope of the paid medical services agreement and the legal nature of the medical confidentiality. The project serve as a basis for improvements of remedies to protect it. Coincidently, the present research offers the opportunities for further investigations.
