Problem of the Responsibility for Destruction of Cultural Heritage during the Armed Conflict

This paper is dedicated to the interdisciplinary research, concerning the problem of responsibility for cultural heritage destruction in armed conflicts. Due to the fact, that the matter of protection is more or less explored and described in scientific literature, the question of responsibility remains relevant, especially in the light of recent decision of the International Criminal Court on Al Mahdi case. In this regard, The hypothesis of this paper is that although all philosophical and legal premises are present, the main obstacle for implementing liability for destruction of cultural heritage is constituted by political reasons. To come to the conclusion, that this is the only obstacle, several questions are answered in this research: what exactly cultural heritage is, why the responsibility for this destruction should occur and why sometimes there is absence of liability for cultural heritage destruction.
