The Title Security as a Mean of Security for Perfomance of Obligation in Russian Law

The present paper in concerned with title security which is a non-defined mean of security in Russian law. Application of title security is based on the principle of freedom of contract and an open-ended list of means of security in Russian law. However, there are substantial grounds for limitation of the principle of freedom of contract and application of title security. This work is divided into four chapters. In the first chapter we shall briefly examine a history of title security, which originated in Roman law. Second chapter provides a short overview of some modern legal orders, in which title security is being applied. In the third chapter the Russian legal order is investigated: the author examines title security and its problems both in terms of court practice and domestic legislation. Finally, in the fourth chapter, according to the conducted research, political, legal and economic reasons the author concludes about validity and possibility of application of title security in Russian law.
