The Relation Between Trademark Rights and Copyrights

The study is devoted to the analysis of the relations between the most significant objects of intellectual property: works of authorship and trademarks. The object of the study is legal relations arising from a collision of aforementioned items. The subject of the research is limited to determining a correlation between various intellectual property rights in case of a copyright item registration as a trademark. The goal of this study is to resolve how rights' holders and authors should act in the framework of aforementioned legal relations to provide both intellectual property rights realization and lawful use of a trademark and a work of authorship. In the current study we also compare the conditions of works of authorship and trademarks legal protection, examine the case of famous artistic work registration as a trademark in the context of fair competition protection, and consider an opportunity of parallel protection in Russian intellectual property law.
