Criminal Liability of Individuals Borne for Breach of Prohibitions and Warrants Issued to Legal Entities

The matter of necessity of implementation of shared criminal liability of legal entities is highly topical in Russian scientific realm nowadays. However, no matter whether that institution will be introduced to Russian criminal legislation or not, legislators and enforcement agents are already faced with dire necessity to have a template for tracking individuals liable for violation of warrants and prohibitions, be they within the structure of a legal entity or outside. Given the fact that many legal entities currently have complicated and convoluted corporate structure, are controlled by shadow directors, are involved in building up sophisticated systems of management and liability allocation - law enforcement is challenged to find a precisely right person to be held liable for a given act. The paper spotlights theoretical concepts of tracking of individuals-offendes inside an entity; aims at establishing ligit subjects of offences, at finding the legal connection between an individual and a legal entity in regard to the relevant offences; and finally it sheds the light on the objective part of crimes played out in the form of violation of warrants and prohibitions
