Law Politics in the Sphere of Raising Funds for Participation in Joint Construction of Real Estate

The purpose of this paper is to study the political and legal grounds that guide the legislator in regulating the participation of citizens in joint construction. In accordance with this goal, we set the following tasks: 1) analysis of the main stages of the development of the legal politics in the sphere of citizens' participation in joint construction since the adoption of the Law on Participation in Joint Construction; 2) study of legal politics in the sphere of regulation of legal constructions that form relations for the acquisition of real estate objects under construction, analysis of the legal nature of the joint construction participation agreement and its comparison with other similar conatracts; 3) study of the legal politics in the sphere of protection of the rights of participants in joint construction, including in terms of the principles of consumer law; 4) analysis of the main problems of legal regulation of joint construction market of real estate objects. This graduation qualification work consists of an introduction, three chapters, conclusion and lists of sources and literature used. Chapter 1 examines the main aspects of the development of legal politics in the sphere of regulation of participation of citizens in joint construction. The legal nature of the joint construction participation agreement and its corellation with other contracts are also examined. Chapter 2 examines the legal politics in the field of protection the rights of participators in joint construction. Chapter 3 examines the problems of legal regulation of the joint construction market. The conclusion is that the main direction of the legal politics is the protection of citizens participating in joint construction as a weak side, as well as the strengthening and expansion of the role of state-controlled public legal institutions that are created with the aim of further protecting the rights of participants in joint construction, guarantees of financial stability of developers.
