The Institute of Lis Pendens as an Obstacle to Parallel Judicial Processes

This study concerning the issues of legal regulation of parallel judicial processes. A performance of contradictory court decisions conflicts with fundamental principles of law. The institute of lis pendens provides an opportunity to avoid a situation when two or more courts held different law decisions about the same matter of argument. The institute of lis pendens is practised on a wide scale in international private law and in foreign legal systems. In the same time, the institute of lis pendens is not fully implemented in the current legislation of the Russian Federation. The author of this study gave a review of court practice and current legal doctrine.
